Privacy CommissionerThe Office is an independent Crown Entity and was set up in 1993. The current Privacy Commissioner is Marie Shroff. The Health Information Privacy Code 1994 sets specific rules for agencies in the health sector to better ensure the protection of individual privacy. The code addresses the health information collected, used, held and disclosed by health agencies. For the health sector the code takes the place of the information privacy principles. Midwifery Council of New Zealand The Midwifery Council of New Zealand was established through the Health Practitioners Competence Assurance Act (HPCAA) 2003. The Midwifery Council of New Zealand is responsible for the protection of the health and safety of women and babies during the childbirth process by providing mechanisms to ensure that midwives are competent and fit to practise midwifery. The HPCAA provides this regulatory framework. The Midwifery Council took over the responsibility for the regulation of midwives from the Nursing Council of New Zealand on the 18th September 2004. Occupational Therapy Board of NZ The Occupational Therapy Board of NZ has been appointed as a body corporate in accordance with the Health Practitioners Competence Assurance Act 2003 (the Act) As an Authority under this Act, the Board is responsible for the registration and oversight of occupational therapy practitioners.The principle purpose of the Act is to protect the health and safety of members of the public by providing mechanisms to ensure that health practitioners are competent and fit to practise their professions. The Board will, amongst other functions, attain this purpose by, determining for each practitioner the scope of practise within which he or she is competent to practise; managing systems to ensure that no practitioner practises in that capacity outside his or her scope of practice, and utilising its powers to restrict specified activities to particular classes of health practitioner to protecting members of the public from the risk of serious or permanent harm.
